LEGAL REQUIREMENTS
The 1998 Working Time Regulations are applicable:
- Four weeks paid holiday a year at times that suit both parties.
- Time off for Bank Holidays or payment in lieu thereof.
Tax and National Insurance
Employers are liable for tax – as well as National Insurance deductions. The necessary forms are available from the Inland Revenue Offices. Failure to make the deductions can have serious repercussions:
- The employer will be liable for tax arrears.
- The nanny will be unable to claim benefits or future state pension.

Other Insurance
Ensure that the following Insurance issues are in place:
- Sufficient Employer’s and Public Liability Cover.
- Car Insurance to cover the nanny, if applicable.
Criminal Records Bureau Disclosures
With a CRB disclosure the Bureau checks the Police National Computer and government lists for people who are not allowed to work with children or vulnerable adults.
Please note the following regarding CRB checks:
- We, as an agency, cannot insist on CRB checks as we are not the direct employer.
- A CRB check can only be requested with the applicant’s consent.
- We encourage applicants to obtain a CRB check, but it remains their decision.
- Employers have to decide if they want to employ a nanny with or without a CRB check.
- Only UK residents of six months and longer can apply for the check.
- The results take an average of four weeks (longer in Scotland) and the original is send to the applicant while the registered body receives a copy.
- Employers cannot insist on receiving the information. To disclose this information to anyone not entitled to it is a punishable offence carrying a maximum sentence of six months imprisonment, or a fine, or both.
- A CRB carries no absolute guarantee of accuracy and in only valid to the date of issue.
- A CRB disclosure does not bear any evidence of a Nanny’s childcare capabilities and we highly recommend that would be employers carry out the reference checks as described under the section "Employment."
